I Won My First TCPA Settlement, and Now I’m Unstoppable

Years and years and years ago, before I even had a clue what the TCPA was, I put my phone number on the National Do Not Call Registry. This didn’t actually do anything — I still received about 2-3 spam calls or unauthorized solicitations per day — and over time, I forgot I had even registered. But thanks to learning about, and exercising, my rights under the TCPA, I’m now at least $1,000 richer and I’m out for revenge.

Note, I say at least because that’s what I was offered right out of the gate by the offending company’s attorney to settle in response to me informing them of my intent to file a lawsuit. However, the offending company has contacted me, unauthorized, several times that would amount to at least $7,500 in pursuable damages under the TCPA. Plus the offending company’s owner was a blatant liar and incredibly rude to boot. So, while I’m tickled pink to know that I’ve been offered $1,000 to settle, there’s no way I’m accepting that little. Instead, I provided the attorney with all of the damning information I had in regard to his client and told them that I’d graciously settle for $3,750. That was yesterday — now I’m just waiting for their reply.

I expect to receive some pushback, but even so, I’m comfortable dragging this to small claims court for the full amount that I’m entitled to receive if need be. In the meantime, I’m out for blood, and have sent demand letters to three other companies that have been spam calling me this past year. If these companies are comfortable disturbing my peace, then I’m comfortable disturbing their wallets.
